The Federal Court of Appeal has decided that a judge's ruling that the government had the right to make a criminal breach of surveillance order less likely, rather than more likely, would have limited impact. Justice Joseph Farrar delivered the judgment last week dismissing a defence challenge filed by the Attorney-General's Department, which argued that the government was likely to succeed under section 5 of the AFP Act. It cited a review by the Director of Public Prosecutions and the Commonwealth Ombudsman in May 2014 as raising concerns about potential abuse of national security powers when making search warrants about telecommunications calls.

The government made that same reference while challenging the Government Communications Security Bureau (GCSB) seeking access to electronic metadata of Australians who had engaged in a foreign national conversations, which included data concerning Australian citizens. The court ruling on Tuesday night gave the government some leeway to rework the legislation that allowed it to make such an exception. The court heard from several high profile advocates for privacy and digital rights including the former head of the ASIO ASIO senior counsel, Chris Sutcliffe, who noted that section 1 of the Crimes Act 1914 protects the public against such surveillance.
