RESUMEN

Dentro de las reformas introducidas en el derecho privado a partir del Código Civil de 1984 y la Nueva Ley General de Sociedades, un sector de los estudiosos del derecho en estas áreas viene pronunciándose por la unificación de las obligaciones civiles y mercantiles, de forma tal que, en defecto de pacto, las normas que resulten aplicables sean las contenidas en el Código Civil en los libros de acto jurídico, obligaciones o contratos, eliminando todo tipo de distinción entre actos jurídicos de alcance mercantil y actos jurídicos de índole civil. Dentro de este contexto, nace la inquietud de analizar ambas instituciones jurídicas en relación a su naturaleza jurídica. Por tal motivo, se estudia si el acto de comercio es un acto jurídico o un negocio jurídico.

ABSTRACT

Within the reforms made in the private rights from the Civil Code of 1984 and the new General Law of Companies, a group of experts of the rights are proposing the unification of the civil and mercantile obligations, so that, against fault of agreement, the application of norms be those that are in the Civil Code, in the books of juridical act, obligations or contracts, eliminating all kinds of distinction between juridical acts of mercantile scope and those of civil nature. In this context, the worry is born to study both juridical institutions related to their juridical nature. For this reason, it is studied if mercantile act is a juridical act or a juridical trade.
