En la práctica, en el proceso de acusación constitucional es posible advertir afectación al derecho a un debido proceso con ostensible violación de derechos fundamentales de la persona lastimando también el principio de separación de poderes, por cuya razón se justifica que merezca efectiva y oportuna atención el control del Tribunal Constitucional en sede parlamentaria. Este trabajo pretende analizar algunas distorsiones en la interpretación y alcances del trascendental derecho al debido proceso en que incurre el Congreso peruano al ejercer función sancionadora y rebasar los límites jurídicamente previstos,

Abstract:

In the experience of pre-trial proceedings, situations involving the due process and consequent violation of a person’s fundamental rights in parliamentary jurisdiction, violate the postulates of the principle of separation of powers and justify that the constitutional control in said venue must deserve special and strict attention.This article seeks to analyze the distortions of interpretation and application of the right to dueprocess incurred by the Peruvian Congress when, in use of its sanctioning function, it exceeds the constitutionally foreseen limits.
